Terms and Conditions for Tree Surgeons Yeading
These Terms and Conditions set out the basis on which Tree Surgeons Yeading provides tree surgery and related arboricultural services to residential and commercial customers. By making a booking, confirming an estimate, or allowing work to begin, the customer agrees to these terms. These conditions are designed to ensure clarity, safety, and fairness throughout the service process. They apply to all work undertaken by our tree surgeons in Yeading, including pruning, crown work, felling, stump-related services, and the removal or disposal of green waste where agreed.
These terms are written for general use and should be read carefully before any service is arranged. Nothing in these terms affects any rights that cannot be excluded under UK law. In the event of any inconsistency between these terms and a written contract agreed in advance, the written contract will take precedence to the extent of that inconsistency. Where these terms refer to “we”, “us”, or “our”, they mean the service provider carrying out the tree surgery work. Where they refer to “you” or “the customer”, they mean the person requesting or authorising the work.

The customer is responsible for ensuring that they have authority to request the works and that any necessary permission from landlords, neighbours, local authorities, or management companies has been obtained before the work date.
1. Booking Process
Bookings may be made following an initial enquiry and, where required, a site assessment or review of photographs, measurements, and relevant information. We may provide an indicative estimate based on the information supplied, but such estimate is not a binding fixed price unless expressly stated in writing. For tree surgery services, accuracy of the initial information is important, as the final scope may depend on access, tree size, condition, waste volume, and safety considerations.
Once a booking is accepted, the customer will usually receive confirmation of the agreed service date, approximate attendance window, and any special conditions relating to access, parking, or permits. The customer must ensure that the site is ready for work on the agreed date. This includes removing obstacles where practicable, securing pets, and making sure that any vulnerable items near the working area are protected or moved beforehand.
If the customer requests changes to the booking, we will try to accommodate them where possible, but revised dates are subject to availability. Any change to the scope of work may affect price, schedule, staffing, equipment, and waste disposal arrangements. Booking Acceptance and Site Information
We reserve the right to refuse or delay a booking if the work requested is outside our competence, if appropriate equipment is unavailable, or if legal or safety concerns prevent us from proceeding. The customer should provide full and accurate information at the time of booking, including tree location, height where known, proximity to buildings or power lines, and any known tree preservation or conservation status. Failure to provide accurate information may lead to additional charges or cancellation of the work.

2. Payments

Payment methods accepted will be confirmed at the time of booking or invoicing. All prices are stated in pounds sterling and may be subject to VAT where applicable.
Quoted prices are based on the information available at the time of assessment. If the customer requests additional work, if conditions differ materially from those described, or if hidden hazards require extra time or equipment, we may issue an amended price before continuing, where practical. Invoices must be paid in full by the due date stated. We reserve the right to charge reasonable costs for recovery of overdue sums, including administration charges and any lawful interest where permitted. Any dispute relating to an invoice should be raised promptly and in writing so that it may be reviewed.
Where a deposit is taken, it may be non-refundable if the customer cancels without sufficient notice, or if we have already incurred reasonable costs in planning, reserving labour, obtaining access arrangements, or preparing equipment. Any refund due will normally only relate to the portion of the service not performed, subject to deductions for work already carried out and costs reasonably incurred.
3. Cancellations and Rescheduling
The customer may cancel or reschedule a booking by giving reasonable notice. We request as much notice as possible so that resources can be reallocated. The amount of notice considered reasonable may vary depending on the size and urgency of the job, but short-notice cancellations may result in a fee where we have already committed labour, machinery, permits, or disposal arrangements to the booking.
If we need to cancel or delay a booking for reasons outside our control, including adverse weather, equipment failure, road disruption, safety concerns, illness, or the discovery of prohibited conditions, we will notify the customer as soon as reasonably practicable and offer an alternative date where possible. We shall not be liable for losses arising from such changes, except where the law requires otherwise.
Where the customer is not present at the time of attendance and we cannot safely gain access, the booking may be treated as cancelled on arrival and a call-out fee or cancellation charge may apply. Similarly, if the work cannot proceed because of an undisclosed hazard, insufficient access, parked vehicles, or missing permissions, the full or partial booking may be charged depending on the circumstances and preparatory costs already incurred.
4. Liability and Customer Responsibilities
We will carry out services with reasonable care and skill and in accordance with applicable health and safety standards. However, tree work is inherently risky and may involve unpredictable natural conditions. Tree Surgeons Yeading shall not be liable for damage or loss that arises from pre-existing defects, hidden decay, structural weakness, subsurface roots, or other conditions that could not reasonably have been identified before the work began.
The customer is responsible for protecting valuable, fragile, or movable items in and around the work area unless we specifically agree otherwise in writing. This includes vehicles, ornaments, garden furniture, fencing, sheds, greenhouses, and decorative features. While every care is taken, we are not responsible for damage caused by items left too close to the working zone where the risk was reasonably foreseeable and the customer failed to take appropriate precautions.
We do not accept responsibility for minor cosmetic marks, lawn indentations, or unavoidable disturbance caused by the use of stump grinders, wood chippers, ladders, ropes, or heavy equipment, provided the work was performed with reasonable care. If damage is caused by our negligence, our liability will be limited to the reasonable cost of repair or replacement, subject always to any limits permitted by law and any valid insurance arrangements.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under UK law. Subject to that, we shall not be liable for indirect or consequential losses, loss of profit, loss of business, or any claim arising from delay unless expressly agreed in writing. If a claim is made, the customer must notify us as soon as reasonably possible and provide a reasonable opportunity to inspect the matter.
Site Safety and Hidden Risks
The customer must inform us of any known hazards, including underground utilities, weakened structures, nesting wildlife, contamination, or any asbestos-containing materials nearby. Where work involves a tree near overhead lines, walls, roofs, or communal areas, the customer must cooperate with any additional safety arrangements we consider necessary. We may stop work if circumstances become unsafe or if third-party interference creates a risk to people, property, or equipment.
Yeading tree surgeons may need to adjust the work method during the job to protect the site or comply with safety requirements. Such changes do not constitute a breach of contract if they are reasonable in the circumstances. If the customer instructs us to proceed against our advice, we may refuse the instruction, withdraw from the site, or require written confirmation that the customer accepts responsibility for the requested approach, where lawful and appropriate.
5. Waste Regulations and Disposal
Green waste generated during tree surgery, including branches, trunks, foliage, and stump arisings, will be managed in accordance with applicable waste regulations and environmental responsibilities. Unless otherwise agreed, we will remove and dispose of waste generated by the contracted work in a lawful manner. Waste may be transported to licensed facilities, reused where appropriate, or processed for recycling in line with environmental best practice.
The customer must not request, and we will not provide, any disposal method that would breach waste law, nuisance rules, or environmental standards. We may ask the customer to confirm whether they wish to keep timber, chips, logs, or other arisings before work begins. If the customer elects to retain any material, it becomes their responsibility once safely handed over or placed at an agreed point on site. We are not responsible for subsequent storage, movement, or disposal by the customer.
If the site contains non-green waste, contaminated material, fly-tipped waste, soil, rubble, or items not generated by our work, this may be treated separately and may incur additional charges or refusal of removal. Any waste transfer, carrier, or disposal records maintained by us will be retained in accordance with legal and administrative requirements. The customer agrees not to interfere with, remove, or misrepresent waste that is designated for lawful transfer or processing by us.
6. Weather, Delays, and Force Majeure
Work may be delayed, modified, or postponed due to adverse weather, high winds, frost, heavy rain, storms, or other conditions that affect safety and access. We will use reasonable judgement in deciding whether conditions are suitable for tree surgery, but our decision may change at short notice if risk levels increase. Where a delay occurs for reasons outside our control, no compensation will be payable unless required by law.
We shall not be liable for failure or delay caused by events beyond our reasonable control, including acts of God, fire, flood, strikes, transport disruption, civil disorder, utility interruptions, or government restrictions. If such an event continues for an extended period, either party may agree to postpone the work or cancel the affected booking without further liability, save for payment due for work already completed or costs already reasonably incurred.
7. Complaints and Disputes
If the customer believes that a service has not been carried out in accordance with these terms, they should notify us promptly so that we may investigate. Any complaint should identify the issue clearly and, where possible, include relevant photographs or other evidence. We will review concerns in good faith and may offer a re-attendance, explanation, partial refund, or other reasonable remedy where appropriate.
Nothing in this complaints process prevents the customer from pursuing any statutory or legal remedy available to them. However, the customer should give us a fair opportunity to inspect and address the issue before arranging third-party repairs or making alterations that could affect evidence or the chance of resolution. Where a dispute cannot be resolved informally, the parties may seek mediation or other alternative dispute resolution methods before commencing proceedings, where suitable.
8. Governing Law
These terms and any dispute or claim arising out of or in connection with them shall be governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising from these terms, unless mandatory law provides otherwise. If any provision is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
By instructing Tree Surgeons Yeading, the customer confirms that they have read, understood, and agreed to these Terms and Conditions. We may update these terms from time to time to reflect changes in law, business practice, or service arrangements. The version in force at the time of booking will normally apply to that booking unless a later written agreement is made between the parties.
